Can I move to a different state without custody order?

More details to this question:
My son has special needs (he is going to be two in February) and there are better hospitals in TN then in PA for specific needs. I am planning on moving in the next few months. With that said, my son’s father pays child support but I have had zero contact with him (minus court appearances) since I told him I was pregnant. I had called when our son was born to see if he wanted to visit in the NICU. He called once we came home from the NICU and nothing. He stated to the judge in our last court hearing in 2012 that he wanted nothing to do with the child so he shouldn't have to pay for the child. There is no custody order for I never found the need to file and pay the money for it. Am I able to move and how would I start the process of moving our case to VA?

TN or VA? Anyway, you need to contact an attorney in the state you are moving to. If the father doesn't take any action to stop you-filing for a relocation hearing-you can move without having to do anything with custody. When you get to where you are going-VA TN, take the existing support order to the local family division. They will register it and transfer the custody order to your new state.
