I filled for divorce last March. My attorney never advised my to filled for child custody stating that I will build economic credit towards my settlement.. The house expenses I. Hanged to join account but food and clothing for my son for almost a year I paid out of my pocket. I went for mediation recently and find out that I am not eligible to claim backdated child support only going forward so zI filled. My question is can I still file for it separately since we reach agreement and soon we will be ready to sign the divorce papers. If I lost child support for almost a year can I sue my lawyer for malpractice since he did not advice me to file.
