Asked on Jun 26th, 2013 on Child Support - Massachusetts
More details to this question:
My son was born 9/13/01 we were never married and were already broken up when my son was born. For the first year of his life his dad would pop up sporadically. He would give me the $50 I requested from him when he came to see him which was very inconsistent. After the first year he never bothered with us again. Never tried to call to see him. I did not pursue child support for one reason only, I didn't want him in and out of my sons life. I took him to court in 2011 and a child support order was issued. He has been in my sons life since then, however inconsistent. My question is, can I request support for those 10 years he didn't pay?
If the case that you filed in 2011 has already gone to Judgment, you will not get retroactive child support. If the case is still pending and it was a Complaint for Paternity, you can ask the court for retroactive child support back to the date of birth.
