QUESTION

Can I sue husband for support during separation?

Asked on Aug 08th, 2014 on Divorce - Pennsylvania
More details to this question:
My husband and I have been separated for 2 years. He's been living with his mistress for 1 year being supported by her. He has a job but I make more money than he does. She makes more money than I. I live paycheck to paycheck now. Bills are behind. Never were when we were together. Can I sue him for support even though we're not legally separated?

There is no such thing as "legal separation" in Pennsylvania. Mistress's paycheck will not matter--the court will compare his net to yours and give the lower earning party 40% of the difference until your divorce is final.
