I recently moved out of state to live with my boyfriend. My son’s father said that if I try to take my son, he will have me arrested for kidnapping. There isn't and never have been a custody order. If there is a support order, there is a custody case. If you want to move, you need his approval or an order of court. If there never was a case filed, then you are free to go and take your child.
