Can I take my son to live with me out of state if there is no custody in place?

I recently moved out of state to live with my boyfriend. My son’s father said that if I try to take my son, he will have me arrested for kidnapping. There isn't and never have been a custody order. I would have taken him when I left but I wanted him to finish the last month of school. I found out today that his dad told him that if I took him he would kill himself. I need help.

If there is a support order, there is a custody case. If you want to move, you need his approval or an order of court. If there never was a case filed, then you are free to go and take your child.
