Can my current husband adopt my son?

More details to this question:
I have a 3 year old son whos fathers rights were terminated when he was 1 year old. I was recently married and have had a little girl with my husband. The three of us all have the same last name of Garland, and I would like for my son to have the same last name. Do I have to actually proceed with an adoption? or is there a way to just change his last name as a way to avoid all of the legal fees. My parents did it with my older brother and sister 20 years ago but I wasn''t sure if thats still possible.

You can change your son's name by legally petitioning the court for a name change or could petition the court for a step parent adoption (which is not complicated).  Please talk to a lawyer in your area and get advice on your options so you can determine which option is best for you and your family.
