When I allowed my son’s father to see him, he abused my son by hitting him with a hanger when he was only 2 y/o. I took my son to CPS, they examined him and ‘found reason to believe’ that my son’s father did abuse him. Now, 5 years later AG opened a case b/c I took my son off medicaid. When trying to close the case my son’s father said he wanted to fight for visitation. My son is now 8 and clearly states that he wants nothing to do with him. I am married and my son calls my husband Dad. With he abuse, it being 5 years, me being married, and my son not wanting to see him does he really have a chance? I live in Texas. I am really wanting to have my husband adopt my son and my son wants that too.
Generally both parents must consent for an adoption to take place. The other option is to terminate the rights of the natural parent. This is difficult to do. You will need consultation with a lawyer to discuss the requirements.
