I live in TX; she lives in CO and filed for divorce and spousal support. Only time there was when I cam to visit my daughter for Christmas. Never lived there together - lived in TX our entire marriage. She is working and has worked during our entire marriage. Will be filing Motion Opposing Jurisdiction
It appear that you are getting good advice to file the Motion. The answer will depend on how long she and the child have resided in CO. If they meet the jurisdictional and venue requirements, the case will be heard there under the law of that state.
