QUESTION

Change in Divorce Decree

Asked on Aug 17th, 2016 on Divorce - Utah
More details to this question:
My husband and his ex-wife divorced in January 2016 and in May 2016, he and I married. We are the primary parents for the kids with visitation with their mom. My husband hasn't sought child support although he is entitled to it. Another issue is in the decree he kept the house but also an RV that has only been used once in the time we bought it. Can we take the ex-wife back to court and have her responsible for half the cost of the RV? He was polite in the divorce, and was making enough over-time to cover the additional cost. Unfortunately that overtime is gone and we are left paying for the kids and this second home which was purchased during their marriage.

Your husband needs to stop being so nice, and actually take care of you and the children. Yes, he might be able to go back to get child support, particularly with the loss of income. On the RV, I doubt you can do what you ask, but I'd have to see the decree itself. There might be a number of solutions, depending on exactly what the decree of divorce says. I'd have to look it over and then we could discuss options and plans. If you and your husband are serious about taking steps to handle these issues, I could assist you if you want.
