QUESTION

Child custody

Asked on Sep 19th, 2018 on Child Custody - Tennessee
More details to this question:
My spouse has joint custody with his child's mother in Michigan. We moved to Tennessee for his job. She has not let him visit the kids let him see them since . She brought the kids here and signed her rights off to a non family member. He was not aware this had happen. Went to the juvenile courts they said all she needed was the birth certificate with her name on it and she could sign them over. On the petition it states the kids does not have a next of kin. Tennessee did not contact him and Michigan did not know anything about it. They still have them having joint custody in Michigan and Tennessee had no idea he even existed. What is his next move have no idea who we need to contact kind of getting the run around right now.

Cases involving two or more jurisdictions (states) involve some pretty detailed and fact specific areas of law.  Depending on certain facts, that might be a Tennessee case and it might be in Michigan case. Once an attorney is able to determine the proper place to file a case, it sounds like you may have a contested custody action. Those are difficult cases, but where the best interest of children is at stake you have to do what you have to do.
