QUESTION

child custody

Asked on Apr 07th, 2014 on Family Law - Florida
More details to this question:
wife just released from rehab for drugs/alcohol. Now living in halfway house. I just learned from her family that this is her 3rd time in rehab. Have notarized statement from her father stating she is unfit to parent at this time. She lost custody of her 1st child to her ex-husband for same reasons. She's willing to sign giving me temporary custody until or if she gets better. I won't file for divorce at this time. I just want to protect my daughter so if wife leaves rehab she can't go to school or sitters house and flee with my daughter. I have limited finances at this time & want to know how to proceed getting custody

unfortunately the best thing you can do is file for divorce and get temporary custody of the child now.  if she gets better you can always drop the divorce case.  Odds are against her full recovery.  If you want to protect your daughter, you are going to have to make some hard choices. MRM
