Child Custody Help

Asked on Mar 30th, 2015 on Child Custody - New York
More details to this question:
I am a father of a 3 year old. I have raised her on my own since she was born. In July of 2014, I signed custody over to my sister to take care of my daughter as finished my school and worked out of town at the time. My sister offered to help and we agreed that once my schooling was complete and I had a job where I was home every night that in May 2015 we would switch the custody back. In the mean time my sister and her husband told me they cannot have kids of their own. I just spoke with my sister and her husband on the weekend to prepare a plan for the switching of custody as May is approaching and they told me THEY ARE KEEPING MY DAUGHTER AND NOT GIVING HER BACK. What steps do I take to get my daughter back? I have a job, a spouse, a steady home , education and good income, I have provided for my daughter since she was born raising her as a single father.. My sister was only there to help me out and now her and her husband are taking my daughter... What are the chances I will win this custody battle? and How do I go about it?

You can file a police report, and also a habeas and custody petition in the Family Court. You are the child's father and you will have greater right than any of her non-parents. If the child is living in New York, then you must file here. If the child is not in New York, then you will need to fight about it in that state. Good luck.
