More details to this question:
My husband has a battery family violence charge against me but my kids from a previous marriage was not home. Their dad filed for an emergency hearing and had my kids taken from me. I had to have supervised visits, even tho my husband was not in the home and then I was granted time with my kids without supervision. Where do I stand legally with getting my kids back.

Set up a consultation with a family law attorney.  There are not enough facts presented to answer the question.  If there has been a material change in circumstances then you may petition the court for a change of custody, but it is just impossible to answer your question on this type of forum.
