Child Relocation

More details to this question:
Father left for military a month after child was born. Located in CO for 7 years. Mother Lived in NY for 6m during this time, relocated to FL with child for a year and a half. Moved back to NY with child after that time. Has lived in NY for 6 years. Father recently (6ms ago) gave Mother permission to relocate with Child to FL again but mother needed to gain funds before move was possible. Father recently was relocated to NY and no longer wants to allow mother to relocate with daughter to FL. Mothers entire family is located in FL except for her own mother is in NY. Sister, cousins, father etc all live in FL. Father is looking to be located about 2.5-3 hours away from mother but both live in the same state (NY). What are my chances of ever being able to move to FL again? Will the courts be favorable to me being that I was given permission and previously lived there? How will visitation work? During those 7 yrs father saw child once a year during leave talks to child 4x a month.

File a petition in the family court to relocate before you move, otherwise he can file to try and bring you back to NY after a move (a very expensive process). The standard will be the best interests of the child, but if you are better able to support her in FL and have more resources, based on what you say about the Father's lack of participation with the child, you may have a chance to move. You might be able to get a free lawyer in the family court if you have low income. Good luck.
