QUESTION

Child Support

Asked on Oct 07th, 2016 on Child Support - New Jersey
More details to this question:
Taking Ex to court for Increase in Child Support. Making less then what I used to make at pervious job. Want to make some changes on the property settlement agreement. Filed in NJ and both live in PA. Going to Court soon. But have a question. On property settlement agreement we both waived our rights to future discovery will that effect my chances of increase in child support and am asking for me the primary custodian to claim my child on income taxes. We have as every other year other party claims. Private School has me only paying and not ex. Since I have a change in income for the worse can I get these things changed of will the waived future discovery prohibit me from doing that. Thank you

I think waiving your right to future discovery means you can't demand any additional discovery from your ex, but it doesn't mean you can't supply more information.  If your circumstances have changed, you can suppy that information and if your ex wants to dispute it your ex can submit additional information, but you have no right to demand your ex's updated income information.
