Child support

More details to this question:
My husband and I live in NJ. His ex girlfriend wants to move to Florida with their child. Can my husband modify child support amount due to the lower cost of living Florida has?

The main issue would be whether your husband consents to the move out of state and whether he has filed any application to ensure visitation and/or custody is appropriately modified if the mother is permitted to move out of state to Florida. As Ms. Anderson states, the lower cost of living is not necessarily going to be a big difference. The child support guidelines are basically computed on the father's income, the mother's income, the age of the child, any unreimbursed medical expenses, any other child support orders and a few other factors.

You can apply to the Court's for a change in circumstance, but I am not sure you are going to be able to get the proof that you needs about the lower ocst of living in Florida.  The child support guidelines are going to depend on your husband's salary, and a slight reduction in the cost of living isn't really going to support the basis for a reduction in child support.
