Asked on Jan 18th, 2019 on Child Support - Texas
More details to this question:
This is for my husband; he started to pay his 3 kids child support on his own with out an court order however this past month he wasn’t able to pay so now his ex is threatening to file child support now my question is since he is illegal would that have anything to do with immigration? He is scared that if that happens he’ll get deported. And he is willing to pay them just that he got a little behind.

Your husband should get child support set up through the attorney general's office so that he gets credit for all payments he made and so that he can be legally declared the father of those children. The family court does not have any jurisdiction over federal immigration issues.
