Asked on Jun 10th, 2013 on Child Support - New York
More details to this question:
My sons father is hardly involved in my sons life. He does pay child support. He is married as well. He just got a new job and hes making more money and possibly making money off the book. Im a single mom and I do work but dont make as much as him and he has another income from his wife. If I took him back to child support is there any chance I can get the support raised?

In New York State, you may seek an upward modification of child support if the non-custodial parent's income goes up by at least 15% from his income used to determine child support for the last order, or, if 3 years have passed since the issuance of the order, regardless of whether his income has gone up by 15%.   If you satisfy either of these, then it is likely that you will be able to petition for an upward modification of child support.
