child Support

Asked on Aug 20th, 2013 on Child Support - California
More details to this question:
I have a child who did not graduate in CA and will be emancipated AUG 30th 2013. She plans on going to school this year to try and graduate, My ex it taking me to court in Sept for child support. My child no longer lives with her mom she lives with grandma and her mom lives there too. CA law i believe says there is an obligation to pay child support until she graduates or turns 19. My question is: since my daughter sis not graduate and she will be 18 and there is no more custody. Am I obligated to still pay? and is mom responsible to pay too?

You understand the law pretty well, so you'd understand that if your daughter is living with her mother at her grandmother's house your obligation to pay child support remains.  It is not vitiated because the mother lives there, but you would ask that the court put a value on the mother having free rent, and that amount would be imputed to her as tax-free income and as it increases her income it will reduce the amount of child support you pay.
