QUESTION

child support

Asked on Dec 04th, 2013 on Child Support - New York
More details to this question:
Good morning, Divorced seven years ago, my ex wife has full custody of both kids. My younger son 13 at the time lives with me everyday 24/7 365. She overtime has wanted nothing to do with him and has caused a lot of his emotional issues. In the divorce she is 100% financially responsible for both kids along with 100% custody. I have never received any kind of support from her over the past 7 years. Can I now sue her for support after the fact?

No. However, you should move for a modification to custody because the child lives with you (unless he's already 18). You can also then move for child support (if he's under 21). Child support generally runs arrears to the date of filing, which means if you didn't file a request for it at the time, you lost it. Good luck.
