child support adjustment in va

More details to this question:
My husband wants to have his CS adjusted to the current state guidelines for CS but his ex is refusing to compromise. He pays 700/mo and his son is now 9 yrs old. She just took a new job making a higher salary then he is and has no other children. We have 2 children together so he has a total of 3 children that depend on him. Can he take his ex back to court for a modification in CS?

First of all this answer does not create a lawyer/client relationship.  You husband may most definately take his ex back to court for a modification.  I would suggest that your husband use his former divorce attorney, and go to court to have his child custody support modified.  I practice Family Law in S.C.
