Hello, My husband is on child supoort (not within the marriage) and the court has ordered him to pay $962 monthly (including $50 for retro). We just had twin boys (2 weeks ago). We are legally married and I am not working and childcare is $1600 monthly for twins, which we can not afford. I got an offer to start working (I'd make more than him) and can cover all expenses. The plan is for him to stay home with the children (do online classes) and work on weekends. Will he be able to work part time on child support (Ofcourse with child support modifications due to major pay decrease at that point)? We don't have family or anyone and right now with this huge order or nearly a grand and the new babies we are struggling and barely making the rent. Please advise.
Congratulations on the twins...not on the cost of child care. Most likely the Court would consider your husband's reduction to part time as voluntary, and thus, not grounds for modification of child support.
As the law presently stands, the court does not consider "after born" children, particularly of a couple that is married, and where there is no court order to pay support for your two new babies, grounds to modify existing child support for the other children.
