Child support modification twice in 2 years?

More details to this question:
My ex and I modified our child support agreement significantly upward about 12 months ago. Now she would like to have it increased again and is filing a motion for change of circumstances. The only change I'm aware of is that her lease is up in two months. Would this be grounds for a significant change of circumstances? Is there any way to fight her petition? We are in NY.

There is always a way to fight to contest the allegations, in this case change of circumstances. Lease being up can raise red flags, and can also come in your benefits as well. If she does not have an adequate place to live, you with your attorney can request custody of the child until she secures a place for her own.
