my wife died. we were together for 1 year. we never documented a common law marriage with the county clerk. we held each other as married during this time. when my wife died i wanted to establish a claim to his estate. can i record the common law marriage at this time and still be her husband and have all legal rights as her husband

Without knowing how long you lived together, what if anything was in the will and all the facts surrounding holding out as a common law married couple I can't give you an answer. There is the possibility of a partnership in property if you contributed to his business and rendered services and you might have an interest in real estate for the same reason. You need a lawyer with knowledge of probate and family law.
