Could I legally remarry if my spouse has?

More details to this question:
Though we were not divorced, my spouse remarried in 2013. Am I now able to legally remarry, or must I obtain a divorce?

You must get a divorce first. It's not all that hard or expensive. She, for her part, is committing the crime of bigamy.

Your spouses remarriage is not no good. No you cannot remarry until you and your spouse are legally divorced. My suggestion is that both of you officially get divorced and then both of you will be able to remarry.
