QUESTION

CPS & Visitation/Phone Calls with child.

Asked on Oct 20th, 2014 on Family Law - Nevada
More details to this question:
Social Worker interviewed myself, my daughter & biological mother at daughter's school, after reports showed my daughter was bitten, scratched & infected from mother keeping infected rats as pets. She was sent to ER per Pediatrician. Mother refuses to get rid of rats and refused to give my daughter prescribed medications. After interviews CPS said case is substantial and proven case of medical neglect & etc. Daughter was supposed to go with Mother that day for her week long visitation but CPS told me after interviewing Mother that I am to temporarily care for my daughter and Mother isn't. Mother is going crazy saying I broke the law and I am with-holding daughter from her and interfering with her visitation rights. I let her talk on the phone to my daughter and she starting tell her that I am a liar and how I "stole" my daughter from her and how it's my daughters fault that her rats have to die now. Daughter started crying so I hung up phone & Mother hasn't contacted again. Help??

I'm not sure what you are requesting.  You have adequate cause to withhold the daughter from the mother based on CPS instructions (and, it sounds like, common sense).  Find out if CPS has hearings set. Either way, consider filing a motion in family court for at least temporary sole physical custody until mother gets her facilities adequate, gets her head straight, and perhaps has a mental evaluation.  If you don't know how to do this, and do not wish to use the self-help forms, you should consult with, and hire competent family law counsel.
