More details to this question:
In neither me or my sons mother has "legal" custody of our child, and I refuse to give him back because I don't feel safe with her having him.. Can she come and take him, or call the cops and they'd come and give him back to her? He has everything he needs in my home, well taking care of. The only thing I'm worried about is I have anxiety issues and it's stated on paper "I'm not allowed to raise a child on my own, due to anxiety" But my mother stays here with me, so I'm not alone with him... So any idea? Thanks for the help

Technically, you can keep him, but Mother could then go and file for custody. It would look better for you if you go and file for custody instead of, as the courts call it, "exercising self-help."
