QUESTION

Custody Battle

Asked on Oct 05th, 2020 on Child Custody - Virginia
More details to this question:
Mother of my child and I lost custody of our oldest daughter about 6 years ago. I had requirements that needed to be met to file for custody again. Which was hold a job, and have my own place for longer than 6 months. I first rented a apartment for a year and half and then bought my own house which I have owned for going on 5 years with a stable job. I have recently found out the grandma who has custody is in the beginning stages of Altimers. There plan is to go back to court and give the Aunt custody and prove me unfit by gathering people against me like my previous girlfriend from over 2 years ago. I also have Full Custody of her younger sister And have raised her on my own for going on 5 years now. I have not been in any legal trouble other than traffic tickets ever since my oldest daughter was born. Which she is now 7. Would they be able to somehow prove me unfit?

Your question cannot be answered in this forum because additional information is needed.  Is this a case involving Child Protective Services?  Are there Court Orders in place that require you to secure housing, obtain employment, etc?  Is there a caseworker in the case  If so, what is your relationship with the worker? I strongly suggest that you meet with an experienced family lawyer in your area to discuss this matter in greater detail.  Lawyers charge by the hour, therefore, you need to discuss the cost of the initial consult upfront to avoid any misunderstandings.  Best wishes~
