QUESTION

Custody Modification

Asked on Jan 28th, 2015 on Family Law - Massachusetts
More details to this question:
I currently have custody of my 3 children. There have been some significant changes and a review of our original order is entirely too vague. We are primarily having an issue with visitation and financial issues. What are grounds for modifying an agreement? My children have been very vocal about not wishing to see their father as much due to emotional/physical abuse that occurred in the past. We had reported this concern but were told because they didn't live with him, there wasn't much that could be done.

Child custody and child support are modifiable upon proving the occurence of a substantial change of circumstances from the issues of the original order that makes it the children's best interest to modify. The standard to modify alimony depends on whether the agreement merged into the divorce decree or whether it survived as an independent contract.  Best wishes.
