Hi Everyone, My ex wife has just filed a petition for an increase in child support. The situation has not changed since the original order was entered except that both of us have had 2 additional children each with new partners. She was just granted a 3% cost of living increase last month. Is there a specific way to ask for the judge to dismiss the case and is it possible at all to request a dismissal? State is NJ. Thanks!! The "specific way to do it: is to file and serve a written Certification (in the proper format and within the time period prescribed in the Court Rules), asking that the "petition" (probably a Notice of Motion) be denied and giving the specific reasons why.
The "dilemma" you have is that people are better off being represented by an experienced Family Law attorney, but that cost money.
