QUESTION

divorce from a different state

Asked on Mar 24th, 2017 on Divorce - Florida
More details to this question:
I have a few questions. First, my husband and I have been legally married since June 2014, but have been living apart since november 2014 and have had little to no contact in the time since. I am currently in a relationship with another man and am 6 months pregnant with not husbands child. My 1st question is, what do I need to do to ensure my husband has zero rights to this unborn child? I must mention that there is a documented history of domestic abuse for which he served jail time. Second, he recently had a lawyer "serve" me with dissolution of marriage papers through my email. Is that recognized as a legal means of "service?" and last but certainly not least, My boyfriend and I moved out of state. I do not wish for my husband to know where I live and it seems the only way to keep my location confidential is to hire a lawyer to represent me. This would be a simple divorce, no children in common and no assets. would i use a lawyer in my current state, or should i look for one in FL?

Florida law states that when a child is born during a marriage, the husband is the legal father and a 3rd party biological father has no rights to the child. Service by email is not proper or legal .  If your husband cannot locate you he may eventually serve you by publication and if you don't respond (which you won't) then he can get divorced where the court reserves jurisdiction to decide division of assets and debts (which also is unlikely to ever happen) and child issues(which it appears your husband is unaware of). This should answer your questions. Good luck,  Cindy Vova
