QUESTION

divorce or custody

Asked on Aug 09th, 2015 on Family Law - Illinois
More details to this question:
My wife has packed her things when I was at work and left. She don't answer any phone calls or textes and have deleted me off of all social media sites. I have asked everyday to see my son. There has been no paperwork filed on either side. She has answer a couple times when I ask to see my son. She tells me to take her to court. I am the only one in the house hold that has an income. I am worried about the safety of my child and don't have any way to find out if he is alright. I don't know what steps to take. Thank for your time

Hello, Anonymous. You should look into filing papers with the courts as soon as possible. This will allow you to get a court order on your side sooner rather than later; you may also be able to file an emergency motion if you are fearful for your son's well-being. Once there is a court order in place, you will have enforceable orders that are required to be followed, and the police will be required to help enforce the court order should it come to that. If your wife is being difficult, unresponsive, and unreasonable, you may want to seriously look into hiring an attorney.  When one party is acting like how you're describing her, it can make the case notoriously difficult, and an attorney's experience can certainly help speed things along and keep it from getting out of hand. I hope this helps.
