Hi there! My husband suggested we should divorce and I agree. However, I'm a stay at home mom, with our 3 children's and 8 months pregnant. Would the divorce with a mutual agreement process more quickly? He is the only financial provider but I am only considering support for the children and parenting time. I am the owner of the primary property purchased before our marriage. Do I have to sell the property the children and I reside in full time?
Good morning.
You have several questions in your email which require more information before responding. I can tell you however, that if there is an agreement on all issues including property division, support, custody and parenting time, then yes the process will go more quickly but there is a statutory waiting period when there are minor children before a final Judgment of Divorce can be entered. Because you have children and are pregnant now, I suggest you speak with an attorney to get a better understanding of your rights and and the divorce process. I would be happy to speak with you via phone when convenient for you. My office number is (248) 594-9991.
Thanks

Because you have minor children, your divorce cannot be finalized for at least 6 months after the date of filing. However, this does not mean that you are automatically divorced once the 6 months have passed. Given your situation with the children and the property, it is imperative that you work with someone knowledgeable with divorce law to make sure your receive everything that you are entitled to. You may have to sell the house, but it is not possible to answer that questin for sure at this stage.
