Do I have to go back to court and file for a modification of custody for my son to return home with me?

My custody agreement sets my ex-husband and I as joint shared custody, with him as domiciliary parent during the school year. The judgement does not specify how long this is for. He was 15 at the time of the judgement but has just turned 16 on January 6 and wants to come home, but his father refuses.

If the father does not agree, you will have to file an action to modify custody.
