Do I need an attorney for supervised visitation?

More details to this question:
My ex boyfriend and I have a one month old baby. He is not on the birth certificate because he was never there throughout my pregnancy. I did not let him around my son so he filed for parenting time and child support. When we were together he would drink. I have pictures of him doing it and I am afraid something will happen to my son when he is around his dad. Iโ€™ve seen his family and him being irresponsible while putting a baby in a car seat. Iโ€™ve seen how they donโ€™t properly place a baby in the car seat and I donโ€™t want that to happen when my son is around his dad and his family. What can I do?

It is likely that the court is going to grant your ex some type of parenting time. If you have some proof of him being irresponsible with children, you might ask the court to put some conditions on that parenting time, like parenting classes, supervision by a responsible third party, etc. I would also ask the court to make it a condition that the dad not drink while the baby is in his custody. Hopefully he'll grow up enough to want to be responsible for your child.

You do not need an attorney to represent you, but you may want to retain counsel in this case to protect your interests and to address your concerns about the father to the court. Parent time for young children is limited under the statutes in Utah. You have the right to request supervised parent time if you have concerns about the ability of the father to adequately care for the child. You may not want to agree to any temporary parent time until there is also an order for temporary child support.

If you wish to make a claim that he should be limited to supervised visitation than you would be increase your chances of prevailing significantly by engaging an attorney. What you are seeking to do is not easy.
