Do I truly need his permission to move with my son, even though I'm not leaving the state?

More details to this question:
I have been accepted to a university and plan to attend the coming fall. Problem is, my son's father does not agree with me moving so far away with my son, even if it is for school. We currently have an agreement (not court ordered) that he sees my son every two weeks from Saturday to Sunday, however, he does not always show.
