Does paying child support automatically give him visitation rights?

More details to this question:
My son, age 23, has a 6 month old daughter. DNA test positive. The father also signed birth certificate. So far, there has been no child support petition by the mother. He would like visitation rights, but we are unclear on how these things are determined. Can he initiate child support payments since the mother has not done it so far? Thank you.

In order to get visitation you must first legally be determined to be the child's father. If not done otherwise that is usually accomplished by going to the local child support agency and asking that paternity be established. That will also result in a child support order. Once paternity is established he will need to file a complaint in the juvenile court asking for parenting time. You will be better off having an attorney file for the parenting time for you.

The two issues are no longer connected; In order to have visitation rights, he must file a motion with the court; Mother should contact the local child support agency about getting a support order.

There are a lot of young men like your son calling me right now, because the only way they can obtain any visitation rights, pursuant to Ohio Statute, is by going to court, having the court rule on the paternity question and then assign visitation rights. We do not necessarily have to rule on child support questions at that time, but can resolve all issue if parties choose. Your son will require a lawyer, without question.
