My husband and I are getting legally/separated divorced. He insists on remaining in the house because he doesn't not want to abandon his child(or that what his legal counsel told him) it is so uncomfortable living with him. How can I get him out?

Negotiate. Perhaps you can work out an agreement that the departure is not usable in a custody dispute.
