QUESTION

Emancipation Question

Asked on Oct 05th, 2015 on Child Support - Utah
More details to this question:
My son turns 18 on 10/15/2015. He is scheduled to graduate High School early on 10/22/2015. Does the child support stop on 10/22 when he has turned 18 and met his graduation requirement? Or do I still pay until May 2016 when he would normally graduate with his class? I just want to make sure that I am paying until May if I am suppose to, or if the emancipation takes place on October 22, I am not paying when I don't need to.

The Decree of Divorce would actually control. Having said that, it usually is turned 18 and graduated from high school, whichever is later. You should consult with an experienced family law attorney to review the decree and, if appropriate, file the appropriate notice in the divorce case to terminate child support. I have handled these types of matters.
