Hi, I am in the process of sepaeration /divorce now , and out of the states with my baby( family trip to our homeland) , the father was here as well but came back alone because he started threating me and i felt unsafe coming back with him home. he is now threating me that will go to the police to say that i kidnapped him. can he do that ? I am planning to go back but I want to be on the safe side and make sure he leaves the house first.

No, he cannot go to the police and say that you kidnapped him if you all went together on a family trip. Now, he can go file for divorce and custody orders that may affect your rights upon your return. You should consider hiring an attorney to help you file for divorce and to obtain a move out order against your husband if you feel unsafe and can provide proof to back up your claims.
