Our sons ex is taking him to court. They have been divorced for a couple of yrs. She left the house. They lived with us for 13 yrs. They have 2 kids a 9 yr old girl & 5 yr old boy. She wants FULL custody,Placmnt of them,Child support,Taxes Every yr,she does want them to see us. Even though she had us taking care of them all summer this summer and we raised them in our house. We are very close to these 2 kids. They are our Only Grandchildren. Her Parents don't have much if anything to do with them but they are our world. We've had them almost every other weekend. Is there anything that can be done about ANY of this? She's constantly telling them bad things about not being able to be here. We don't talk negatively around them about her her boyfriend or her family. What goes on between the adults should be between the adults not putting the kids in it. They're dealing with enough. Please help us?
1. You can petition for visitation rights to your grandchildren under Wisconsin's so called "grandparents visitation" statute. Your schedule for visitation would be independent of your son's right to placement of the children. 2. On the second issue, you don't offer any facts or evidence to indicate what the mother's case is built around. Just because "she wants FULL custody," doesn't mean she gets full custody. The laws in Wisconsin are pretty strict when it comes to petitioning to modify placement or custody post judgment. She must prove that there has been a substantial change in circumstances and must overcome the legal presumption that things should be left as is. You indicate they were divorced for a couple of years, but it is important to know exactly when they were divorced, as there is also a law that withiin the first two years from the divorce, neither party can petition the court to modify custody or placement, unless there is a showing that the children are in imminent harm.
