Filling petition for husband

More details to this question:
Hi, If my husband of 5 years entered the US w/o inspection as a toddler but now holds a DACA and work permit card would he have to leave the US and go back to the country where he was born to file for a petition? We have a child together and I'd hate for our family to be separated.

You do not need to be a United States citizen to file for divorce in Florida.  You also do not need to have been married in Florida in order to file for divorce in Florida.  But at least one of the spouses must have been a continuous resident of Florida for at least 6 months before the divorce proceeding is filed.
