Getting paternity test order thrown out?

More details to this question:
I live in Oswego county, ny and have a 10 day old son who I knew who the father is so he ordered an at home non legal paternity test just to be sure and it came back positive so he signed the paternity affidavit and is on the birth certificate there is now a man I was seeing but did not have sexual relations with at that time who is trying to file for a paternity test in court, if I bring my evidence of the non legal test affidavit and birth certificate will his case get dismissed or will he be granted his paternity test?
