QUESTION

Grandparent visitation?

Asked on Jan 20th, 2012 on Family Law - Arizona
More details to this question:
Me and my fiance had a babygirl last year. We had a very strained relationship wit hhis parents and they have seen my daughter maybe 5 times total. Shortly after we cut off contact with them they served us with papers for grandparent rights on the clause that she was born out of wedlock we are in AZ. We live together and raise her together what are the chances of them actually getting visitation rights? A little background my fiance was abused as a child and into adulthood and the interference of his parent in our relationship is just too much hence the fact we cut off contact

This question may be more complicated than what can be answered here, so I recommend that you speak with an attorney to discuss this matter in more detail. Generally speaking, the court must enter orders that are in the best interests of the child; however, the courts also prefer to defer to the parents in making decisions about who can have contact with their child. It helps that you and the other parent are in an intact relationship and that you both agree it is best for his parents not to have contact with your child.
