QUESTION

How can discovery be reopened in Divorce Case?

Asked on Dec 09th, 2014 on Divorce - New York
More details to this question:
I filed for divorce in 2010. EBT's were completed in 2011. Last August, the case was switched to a new judge. The case was marked for trial. Then my spouse agreed to binding arbitration. Spouse. Two months ago, just before the arbitration, my spouse changed attorneys. Today I received a letter from my attorney's office advising me of a date I must appear for an EBT at her attorney's office. How can discovery be reopened at this point? Should reopening discovery have required a motion that I should have known about?

What does your current set of orders from the Court say? What does your attorney say? If you're pro se in a battle that has run for over four years and there's enough money to be doing repeated EBTs, arbitration and extensive discovery...there's something very wrong with the picture.
