Asked on Apr 10th, 2017 on Child Custody - Florida
More details to this question:
I was arrested and the judge gave me only 30 days to pay an amount that I’m unable to pay at this time. He has threatened 30 days in jail if I don't pay my Purge within this time frame. I am currently unemployed and am also 7 months pregnant and have a 7 year old daughter at home.

The way to avoid jail time for child support is to pay the support. If you do not pay the support, you can go to jail for up to 6 months for each instance of contempt. Once a purge amount is ordered, and you do not pay it, a writ of bodily attachment will be issued and you will be picked up and taken to the jail.

You should seek legal representation, perhaps through your local bar association or legal aid society, to assist you with filing a modification action to reduce your child support obligation, as well as representation in what appears to be a contempt/enforcement matter. Generally, when a judge sets a purge payment, they have already determined that you have the present ability to pay. Consult with an attorney to discuss the specifics of your situation and your options.
