How can I change my daughter's last name without her "dad's" permission?

My kids haven't seen their "dad" in a year. He was given supervised visits twice a month for an hour each visit & but chose to do 1 visit a month for an hour each visit. He cancelled most of the visits so the case worker closed the case. He hasn't bothered taking me back to court for more visits. I have sole custody of both our children. My daughter is the oldest & she has his last name but my son has my last name. Is there a way I would be able to change my daughter's last name to the same as my son & I? She wants the same name as us.
