How can I change my son's name back?

More details to this question:
I was unwed when my child was born he had my last name his dad wouldn't come to the hospital to sign papers so he did a home DNA and then signed the parental affidavit then shortly after was in an out now he has no contact with my child he has never been to your for visitation or support. Now I would like to return my son's name back to mine because it's what he calls his self an what's on his SSC I want his birth certificate to have my last name what can I do without involving my child's father.

The reason that your son calls himself that and his social security card says what it does is because you taught him and filled out the forms incorrectly. You can't use your own poor decisions as justification for a name change. Notice has to go to the father of any attempt to change his name, and then the court will decide whether it happens. If you are now married and your husband would like to adopt, it certainly sounds like that could happen. Either way, an attorney in your community can prepare the appropriate petition to file in court.
