I have a daughter who is 3 years old, almost 4. I was not married to her mother. When she was only a couple of months old her mother went to jail in Tennessee. I was working in Michigan, so my mother came down from Michigan and got my daughter and her brother. Shortly after I was incarcerated. I am now 3 years sober and 1 year out of jail and I want custody restored of my daughter. Her mother is still incarcerated and has little contact. My mother is in Michigan and I am in Tennessee and I am being told I will have to go to Michigan and take my mother to court to get my daughter back. Is this accurate or is there something else I can do? My mother only has guardianship.
It will depend on what court maintains jurisdiction in this matter. Did you mother obtain the guardianship through a Tennessee Court, Michigan court or some other jurisdiction? Once you determine the state and court that maintains jurisdiction then you can move forward.
