My son lives with me and he's three yrs old I want sole custody cause the mom has too much going on and is not stable at all with two more kids.

You will have to file a motion, and you can seek immediately leave if there is a clear and present danger to the child.

There is no guarantee that you can get sole custody and, if she fights, it will not be fast. The best you can do is petition the court for custody and ask for sole legal and physical custody and prove that the child is in danger with mom. I suggest you hire an attorney because this is a difficult case to prove.

New Jersey courts do not favor "sole custody" arrangements without just cause. Since the child already lives with you, you have residential custody, or said differently, you are the parent of primary residence. Your situation does not appear to be broken which begs the question, "why are you trying to fix it?"
